Spring Social May 8, 2014

Socialization is the process by which we learn from others; experience camaraderie; and, revel in great moments of joy. Psychology Today notes that human beings are social animals and the tenor of our social life is one of the most important influences on our mental health. Without positive, durable relationships, both our minds and our bodies fall apart. Accordingly, an integral part of advancing the mission of our committee is connecting people with people. Our connections add to our personal and professional lives. Our interactions lead to significant positive impacts on our communities.  The connections we make in professional organizations create opportunities to improve the lives of others by providing basic necessities like food, clothing and shelter.  Collaborative efforts can be fostered through social interactions which can give a collective voice to issues and concerns that affect those in the legal profession. Together we can move agendas forward.

So, please join us for the Attorneys in Public Service Spring Social to celebrate the friends we make in the process of being of service. Hope to see you on May 8, 2014 from 5:30 p.m. to 7:30 p.m. where we will enjoy a formal welcome from Albany Mayor Kathy Sheehan in the Bordeaux Room at Provence in Stuyvesant Plaza.

This is a call out for the APS Committee RUN/WALK AGAINST DOMESTICS VIOLENCE TEAM.  This May 1 the Albany County Bar Association celebrates the twentieth year of the run against domestic violence.  The APS Committee is putting an APS TEAM together to walk and/or run in the event this year – to show support for this fantastic event.  Anyone (and by that we mean anyone, whether a member of the Albany County Bar Association or APS Committee or not) that would like to participate on the organizing sub-committee and/or join the APS TEAM to walk/run is asked to contact Dan Hurteau at nixonpeabody.com.  The APS Committee intends to have special shirts for all APS TEAM members – and a tent at the event for the APS TEAM.  We are looking forward to a great day of supporting the cause and getting outside for some fresh air (which will be refreshing following what seems like a very long winter). 

In other highlights on the APS Committee social calendar, in early May the APS Committee will hold its annual gathering at Provence in Stuyvesant Plaza.  More to come on that event.  Also, please submit any and all applications/nominations for the APS Committee Service Awards.

Innovative Approaches to Juvenile Justice in Albany County

“You do what for a living?” my new acquaintance exclaimed indignantly. “Yes, I am a prosecutor of juvenile delinquents.” I replied with a smile. “But, don’t you know you are ruining those kids’ lives?!”
This is a question and reaction that I often face when explaining to others the nature of my profession. As an Assistant County Attorney, it is my job to bring juvenile delinquency petitions when a child aged 7 to 15 is alleged to have committed a crime. It is also my job to evaluate cases and, where appropriate, recommend “diversion” which enables the child to avoid a criminal record, while still being held accountable for his or her actions through informal supervision of the County Probation Department. The vast majority of criminal activity committed by youth under the age of sixteen is sent to diversion where children receive therapeutic services, pay restitution, are required to do community service, and write apology letters; all in addition to a period of supervision.

The advantages of working with the system involving youths in contrast to adults are many. The juvenile justice system is rehabilitative in nature. As a prosecutor, I have the unique opportunity to work with community based service providers in crafting a resolution that is tailored to fit the child’s needs. Requiring participation in mental health counseling, substance abuse treatment, anger management, and other therapeutic intervention is a large factor in diverting kids out of the justice system and back into mainstream society. Under the leadership of County Executive Daniel P. McCoy, Albany County is taking exemplary strides, particularly in the areas of addressing juvenile crime, recidivism and ensuring that appropriate programming is both available and accessible. 

One of the newest such initiatives is the Juvenile Detention Alternatives Initiative (JDAI), which is a collaboration between the Annie E. Casey Foundation and several counties throughout the state. The goals of JDAI are to eliminate the inappropriate or unnecessary use of secure detention; minimize re-arrest and failure-to-appear rates pending adjudication; ensure appropriate conditions of confinement in secure facilities; redirect public finances to sustain successful reforms; and reduce racial and ethnic disparities. Albany County will be joining a network of over 200 other JDAI sites throughout the country and will be able to draw on the wisdom of those who have been applying the principles and reaping the positive results of JDAI for decades. JDAI is a data driven initiative and requires counties to compile and evaluate their juvenile crime data in new and innovative ways to form solutions to chronic problems such as disproportionate minority contact and unnecessary lag in case processing timelines. We look forward to a full roll out of JDAI and the positive results it will have for both adjudicated youth and the community at large.

Another initiative that is currently in its infancy, but promises to be an innovative and evidence based approach to holding youth accountable for their criminal activity, is called “Project Growth.” This county-wide initiative seeks to partner adjudicated youth that owe their crime victim a restitution sum for damaged or stolen property, with a work placement in the community that will allow the youth to earn money specifically for the purpose of compensating their victim. This approach has been utilized throughout the United States and has garnered excellent results in North Carolina, Arizona, California, Florida, Massachusetts, New Hampshire, Vermont and Georgia to name a few. These states were able to increase the amounts of restitution paid to victims and lower recidivism rates for program participants while teaching youth marketable skills and the value of a hard day’s work. Project Growth is the first county run program of its kind in the State of New York and we look forward to evaluating its success. 

There are a multitude of factors that contribute to the delinquency of a child and as a community we have an obligation to do our level best to address these factors before they enter the adult criminal justice system. The adult system lacks the service provision options of the juvenile system and because mandatory school attendance provisions do not apply, youth sixteen and older can easily become disconnected from mainstream society. Keeping juveniles engaged and supported is imperative and thankfully, the leadership of Albany County agrees. It is a privilege as a prosecutor to have such supportive leadership and the opportunity to be an active part of the solution for these youth in addition to protecting the community of our county as a whole.

After a break to enjoy this glorious summer, the APS Committee is back! We invite your energy and your ideas at our monthly meetings which will be our vehicle to move our 2013-2014 agenda forward. Our agenda includes expanding our collaborations with other public service attorney committees and community organizations; creating and delivering an Ethics in Social Media CLE; recruiting writers to highlight public service attorneys and organizations in our monthly Albany County Bar Association (ACBA) articles; hosting social gatherings; shrinking the gap between the private and public sector and supporting attorneys in public service by creating an ACBA APS LinkedIn Group. As the APS committee continues to expand it is our intention to have a greater impact on the community and move the notion of public service beyond government. We intend to create APS Committee group opportunities to support our community and we encourage you to get tuned in to honoring and sharing the gifts you have in any way you are able.  Whether it is contributing to our community though donating food or volunteering at the Regional Food Bank of Northeastern New York http://regionalfoodbank.net/volunteer/volunteers/, assisting with the ACBA’s YLC Habitat for Humanity efforts on November 16, 2013, rounding up scarves and hats this fall to donate to a local charitable organization or participating in any one of the many pro bono opportunities in our region, our community is delighted with your efforts!

The Albany County Bar Attorneys in Public Service Committee ("APS") in conjunction with the New York State Bar Association's Committee on Attorneys in Public Service ("CAPS") held a social on May 16th in the Bordeaux room at Provence.  With approximately thirty people in attendance, including several judges and attorneys in both private and public practice, it turned out to be a fantastic event. The setting was perfect for mingling, networking, catching up with old friends, and making new ones.  Not to mention, the hors d'oeuvres were amazing!

Those in attendance were greeted with opening remarks by the Honorable Karen K. Peters, Presiding Justice of the Appellate Division, Third Department.  Judge Peters explained how her various bar memberships assisted her throughout her career.  And, she indicated that while she started her career in private practice, where her bar association liaisons provided her with, among many other things, education, information and referrals, most of her career has been in public service where her bar association activity has been equally important. In fact, Judge Peters indicated that it was at a bar association event when she was first strongly encouraged to run for Ulster County Family Court Judge by her peers - at a time when no woman had ever run. 

Like Judge Peters pointed out, bar membership is relevant to all attorneys.  The mission of "APS" is to provide public sector attorneys with opportunities for information sharing, pro-bono engagement, community outreach, networking and camaraderie with their private sector peers.  The event at Provence did just that!

On June 4-5 2013, the New York State Office of Information Technology Services, the NYS Forum, Inc. and the University at Albany’s School of Business and College of Computing and Information will present the 16th Annual NYS Cyber Security Conference and the 8th Annual Symposium on Information Assurance (ASIA ’13), titled, “Helping Navigate Stormy Seas” at the Empire State Plaza in Albany, New York.  The APS Committee encourages you attend this important event and visit http://www.dhses.ny.gov/go/conference2013 to view the Agenda and receive updates on the conference.

These are stormy times in the world of information technology.  Hacktivists, scammers, insiders, organized crime, as well as nation states, are contributing to the growth of cyber crime.  Our Nation’s critical infrastructure has become the target of cyber attacks.  No organization - government, large or small business, not-for-profit, or school - is immune.  It is likely that all such organizations have experienced the effects of a cyber incident, endured a virus outbreak, received a phishing email or had a network and website scanned for vulnerabilities.  Help is needed to safely navigate an organization through these threats and risks.

• 23% of users are running old or outdated web browsers, creating huge gaps in online security (Kaspersky Lab, Global Web Browser Usage and Security Trends, November 2012).
• SQL injection attacks rose 69% in the second quarter of 2012 compared with the previous quarter (Firehost Web Application Attack Report for the Second Quarter of 2012).
• As of December 31, 2012, the Privacy Rights Clearinghouse had reported 680 breaches nationally that involved 27.48 million sensitive records (Privacy Rights Clearinghouse).
• 97% of breaches were avoidable through simple or intermediate controls (2012 Verizon Data Breach Report).

During this season of renewal, the APS Committee reaffirms its commitment to building partnerships to deliver CLE programs, community service opportunities, and social and professional networking events. We are proud to report on the success of the Third Annual Albany High School Youth Law Day. This event was collaboration with the Capital District Black and Hispanic Bar Association and Albany High School. We thank our APS Committee member Hon. Helena Heath-Roland for organizing the attorney participation for the event. We appreciate the efforts of Albany High School’s administration and the school’s event coordinator, Lawrence Moultrie, for providing this outstanding opportunity for students to meet attorneys and judges and to learn about the pathways to a career in the law with an emphasis on public service.

On March 6th, the following public and private sector attorneys as well as representatives from the bench presented to Albany High School students from all grade levels:  Daniel Bernstein, Tony Cantore, Paul Czech, Sara Fedele, Hermes Fernandez, Helene Goldberger, Richard Goldman, Hon. Victoria Graffeo, Peter Halewood, Lisa Harris-Eglin, Hon. Helena Heath-Roland, Patrick Higgins,  Benjamin Hill, Amanda Kuryluk, George Lamarche, Ann Lapinski, Caitlin Monjeau, Frank Munoz, David Nardolillo, Andrew Safranko, Donna Young, and Allison Zullo.

These 22 participants spoke to the students about the legal profession, the challenges they faced and overcame along their path to a career in law, and how the students can achieve their goals and dreams. This opportunity is time well spent for all of us. Giving back to our community and inspiring our young people to be steadfast and determined in setting a course for their success is an everlasting gift. We look forward to increasing the number of participants next year and continuing to encourage students to pursue higher education as we increase their knowledge of the various choices for a career in the law.

In closing, we are happy to report the APS Committee is growing by leaps and bounds, and we look forward to welcoming more new faces this Spring! We welcome speakers at our lunchtime Committee meetings. The APS Committee is excited about collaborating with the Capital District Black and Hispanic Bar Association by participating in the Albany High School Youth Law Day.  The purpose of Law Day is to provide students with exposure to the many aspects of the practice of law and for students to see the many paths that individuals take to become lawyers.  I participated in the AHS Law Day last year and had a great experience talking to students and convincing them that “LA Law” was not a great example of how lawyers spend their days.

We’ll be sponsoring another CLE on Ethics in April, providing Public Service and other attorneys the opportunity to obtain Ethics credits while learning about the transition to the new Joint Commission on Public Ethics.  The changes have an impact on executive branch and legislative employees and those who interact with both of those groups.

The APS Committee is off and running in 2013, after a spirited meeting in January.  The Committee again wants to thank our guest speaker Ms. Catherine A. Christian, Counsel to the Trial Division and Chief, Alternative Sentencing Division in the Office of the Special Prosecutor, who spoke about her role as chair of the NYSBA CAPS committee and the potential for our committees to work together in 2013.           

The APS Committee set forth an aggressive agenda for 2013, including community service events, social events and continuing legal educations programs.  Importantly, the APS Committee also discussed initiatives to advance the involvement of attorneys in public service with the Committee.  The hope is to grow the number of attorneys that participate regularly in the monthly meetings and in the various events that are planned for the year.  The Committee is planning to invite guest speakers to several meetings through the year and to seek out opportunities for joint activities with the NYSBA CAPS Committee.  The Committee is also planning to start a LinkedIn Group so that Albany County attorneys in public service have a location on social media where they can share information, work experience and other topics of interest.  The hope is that the LinkedIn Group site provides another outlet for Committee activities and planning.

The next meeting of the APS Committee will be on February 27, 2013, at the offices of Nixon Peabody LLP, 677 Broadway, Albany, and there will again be a phone conference set up for anyone that wants to participate remotely.  The APS Committee strongly encourages participation in the meetings and the many upcoming events, which will be announced and discussed in this column through the year.

The APS Committee is ready to kick off 2013 with a fantastic guest speaker at our January 16, 2013 meeting.  Ms. Catherine A. Christian, Counsel to the Trial Division and Chief, Alternative Sentencing Division in the Office of the Special Prosecutor for the City of New York will share her experiences in public service and speak to the importance of community involvement for public service attorneys. 

As we grow and cultivate our public service membership, we hope to provide information relevant to public service attorneys and resources for encouraging collaborations between private and public service attorneys.  This month, the APS Committee reminds attorneys in public service to be aware of the Federal Loan Forgiveness Program. The United States Department of Education reports that in 2007, Congress created the Public Service Loan Forgiveness Program to encourage individuals to enter and continue to work full time in public service jobs.  Under this program, you may qualify for forgiveness of the remaining balance due on your eligible federal student loans after you have made 120 payments on those loans under certain repayment plans while employed full time by certain public service employers. The ACBA Committee on Attorneys in Public Service (“APS” Committee) is excited to launch our inaugural article! Being a public service attorney provides daily fulfillment of community service. The work we do allows government to be administered, services to be provided, industry to be regulated and matters to be adjudicated. The APS Committee provides opportunities for information sharing, pro-bono engagement, volunteering in our community, networking and camaraderie.  When we engage in these activities we elevate our profession and our role as public service attorneys. 

The APS Committee has organized the involvement of ACBA attorneys to participate in the newly created Youth Law Day program at Albany High School.  The Youth Law Day program invites APS attorneys to address students and discuss their path to becoming a lawyer; challenges they faced and overcame; support they received from mentors along the way; the work they presently do; and, provide advice on how students can best accomplish their goals to pursue higher education and law school for those interested in our profession. Stay tuned as this program will again be offered to ACBA members to participate in the Spring of 2013.

With each small act we take to volunteer and participate we make larger our community of attorneys with whom we can share knowledge and resources to advance the quality of service we bring to those we serve.  Joining the APS Committee provides the benefit of learning something new and working with others of like minds in your area of expertise. We welcome you to the APS Committee and look forward to seeing you at our next meeting on January 16, 2013 at the offices of Nixon Peabody LLP, 677 Broadway, 10th floor, in Albany.  The featured speaker will be Catherine A. Christian, Counsel to the Trial Division from the Office of the Special Narcotics Prosecutor for the City of New York and the head of the NYSBA APS Committee.

Youth Law Day at Albany High School

The ACBA Committee on Attorneys in Public Service ("CAPS" Committee) had the pleasure of organizing and participating in the Youth Law Day held at Albany High School on November 10, 2011.  Under the leadership of Albany High's Principal, Dr. David McCalla, an outstanding opportunity was provided to students for them to meet public service attorneys and learn about the pathways to a career in the law.
Our Committee, working in collaboration with the Capital District Black and Hispanic Bar Association, identified eleven attorneys to speak with primarily Juniors and Seniors in 18 classrooms throughout the day.  The presenters included ACBA members Tony Cantore, Ann Lapins
