Cynthia Feathers wrote the plaintiff's brief in Schlanger v. Doe, ___ AD3d ___ (3rd Dept July 10, 2008). In that case, after a backhoe manufactured by the first defendant was loaded onto a tractor-trailer by the second defendant, a backhoe window shattered as the vehicle traveled beneath an overpass. Facing flying glass debris, the third defendant swerved and struck the plaintiff's vehicle. The Third Department held that Supreme Court (Ceresia, J.) had erred in granting summary judgment to the third defendant, since there were triable issues about whether he faced an emergency and, in any event, responded reasonably. The reviewing court also found that claims should go forward as to the first defendant, based on circumstantial evidence of a manufacturing defect, and as to the second defendant, based on res ipsa loquitur.
