2nd Annual Bike Safety Day
On July 17, 2008 the ACBA is holding its Second Annual Bike Safety Day at the Empire State Plaza.  Board member Janet M. Silver and ACBA member John Hartzell are co-chairing this year’s event, with ACBA members Ryan Donovan, J. Michael Naughton, and Kristin Pratt .  We thank them for their efforts.

Please come out for this event, either as a firm sponsor, or as a volunteer on the day of the event.  It is from 5-7 pm.  It is very difficult to have a bad time helping children and giving them free bike helmets.  Please stop by and help us out. 
 

Dear Members:

On July 17, 2008 the Albany County Bar Association will host its 2nd Annual Bike Safety Day, held at Empire State Plaza from 5-7 p.m.  With the help of the local police and fire departments, hospitals, doctors and lawyers we hope to protect children by giving out helmets and thereby imparting their necessity for riding safely.

Last year's event was a huge success.  Approximately 200 children from the capital region were fitted with bike helmets free of charge.  In addition, the children completed a bike safety obstacle course and were awarded a merit of certificate for their accomplishments.  We anticipate serving the same number of children this year. We are seeking assistance from local attorneys or law firms to sponsor the event. Donations will be used to offset the costs associated with holding the event, including the cost of the bike helmets given to children. 

A donation of $500 or more will make you or your firm a "sponsor" of the event.  As a sponsor, your name or the firm name will appear on our flyers.  If you are interested in being a sponsor, please contact Barbara Davis at 445-7691.

A donation less than $500 (in any monetary amount) will make you or your firm a "patron" of the event.  As a patron, your name, or the name of your firm, will be published in the August issue of the Albany County Bar Association Newsletter.  Patron donations will be accepted up to the date of the event. 

In addition to monetary donations, we are looking for volunteers to assist us on the day of the event.  This would be a terrific opportunity for members to give back to the children of Albany County.

Boston Breast Cancer Walk
This summer, Executive Director Barbara Davis will be participating in the Susan G. Komen Breast Cancer Walk, being held in Boston August 15-17th.  Barbara will walk 60 (that’s right, 60!!) miles to help raise funds to find a cure for breast cancer.  Eighty-five percent of the net proceeds of this event go to Susan G. Komen for the Cure Every advance in breast cancer research, treatment, education and prevention in the last 25 years has been touched by a Komen for the Cure Grant.  The remaining fifteen percent of net funds goes to the National Philanthropic Trust Breast Cancer Fund, which provides ongoing support to breast cancer initiatives, so that strides made today can continue to propel us toward our goal.

Please consider supporting Barbara in her efforts by making a donation in her name.  You may either go to the website at www.The3Day.org or send a check, payable to “Breast Cancer 3-Day”, to our office-- whichever is easier for you.   Breast cancer has tragically touched the lives of many of our members.  Please join Barbara in helping to fight this disease.

Diversity Internship Program

The Diversity Internship Program celebrated completion of its eighth year on April 29, 2008.  A reception was held at 677 Prime to recognize the firms that have supported the Diversity Internship Program and to honor the students from the 2007-2008 school year who have completed their internships at various Albany law firms.

Speaking at the reception was Pershia Wilkins of Albany Law School who announced that there had been a marked increase in minority enrollment at Albany Law School and that there would be a greater number of students seeking out the opportunities that the Diversity Program provides.  The attendees were honored by the attendance of the entire Court of Appeals whose presence recognized the importance of the program and provided an opportunity for interaction between the judges, firms and students.  The Honorable Judith Kaye spoke at the reception as well, acknowledging the significant work that the Albany County Bar Association has done to promote diversity in the legal profession.  Participation by all firms in the Capital District is encouraged and you can obtain more information from the ACBA website or by contacting Jim Kelly at 464-1300 Ext. 312.  Assignments for the 2008 fall semester will be made at the end of August and firms are requested to advise their participation at this time.

NYSBA President’s Pro Bono Awards

On Law Day, May 1, Judge Kaye once again gave an inspiring and elegant speech at NYSBA’s 2008 Presidents Pro Bono Service Awards luncheon, held at The State Room in Albany.  One person from each Judicial District was given an award for outstanding pro bono service.  Congratulations to Cynthia Feathers, who won the award in the Third District for her work in the Julia BB appeal.  The case, begun in 2003 in Family Court, was handled by Cindy first in the Appellate Division and ultimately in the New York Court of Appeals, where she was victorious. Cindy devoted her free time to compiling the complex appeal and truly went above and beyond in her efforts.  We applaud all of the other attorneys who won the award this year and we recognize also that there were many lawyers who performed pro bono services and were not honored this year.   We at the ACBA thank all of you sincerely for the work you do!

14th Annual Law Day Run Against Domestic Violence

On Friday, April 25, 2008 the Albany County Bar Association had its 14th Annual Law Day Run Against Domestic Violence.  It was an incredibly successful day and over $16,000 was raised to fight domestic violence in the Capital District.

On this beautiful spring evening, we had over 350 participants!  Thank you to our Law Day Run Committee: Douglas Kemp and Elizabeth J. Grogan, Co- Chairs, Daniel W. Coffey, Tricia George, James Green, Benjamin Mastaitis, Diane Metz, Amanda Petrie and Robert Rausch.  Their efforts cannot go unnoticed and the event would not have been such a great success without their assistance.

Finally, thank you to each and every volunteer, including Diane Metz, who once again assisted us in organizing all of the volunteers.  This race would not have been possible without their efforts.

At a time in which lawyers are deemed not to provide any type of assistance in the community, we are particularly proud that the Albany County Bar Association has worked so hard to raise this money which will be used to fight domestic violence by providing services such as security deposits, new locks, clothing, emergency housing, moving assistance and other valuable services.  We look forward to all of you participating next year and thank you again.

NYSBA Annual Meeting 

ACBA Bike Safety Day wins NYSBA Merit Award
The New York State Bar Association Annual Meeting was held during the week of January 28th in New York City. At the Bar Leaders Breakfast, the Albany County Bar Association was awarded the NYSBA Merit Award for Bike Safety Day!  We appreciate Pat Higgins’ hard work in spearheading the project and making it such a success.  We look forward to many more!

Pro Bono Coordinators Network
During the NYSBA Annual Meeting, the Pro Bono Coordinators Network met to discuss new initiatives and programs around New York State.  We also got a formal introduction to NYSBA’s new Director of Pro Bono Affairs, Gloria Herron Arthur, who did an amazing job of organizing the meeting (no easy task with over 50 attendees).  We look forward to a continued productive working relationship and wish Gloria all the best in her new role!

Empire State Counsel

IOLA

Once again the IOLA Fund for the State of New York has demonstrated its commitment to providing civil legal services to low-income New Yorkers and has made it possible for the ACBA to continue to provide these services to those who need it most.  We are deeply appreciative of the grant we received for our Pro Bono Program and look forward to expanding our services in 2008.  Did you know that different banks offer different interest rates on IOLA accounts?  Interest rates and net yields are all posted on their website, http://iola.org/.   We encourage firms to seek out banks that offer higher interest rates on IOLA accounts, as these monies are then given back to agencies that offer free civil legal services. 

Of course, none of our programs would be possible without assistance from IOLA, Senator Neil Breslin and the Albany County Bar Foundation.  It is because of these generous gifts that we are able to provide critical legal services to the low-income members of our community!

In an effort to accomplish our goals, we hope to be able to offer more training for attorneys who are willing to provide pro bono legal services.  If there is a particular area of law in which you think training would be beneficial, please email me at sblank@albanycountybar.com.  I look forward to hearing your suggestions and also to another banner year for pro bono services!

Military Pro Bono

Holiday Party

>TIS THE SEASON!!! And our 13th annual Holiday Party definitely confirmed that!  The Legal Aid Society, co-sponsors of the event, presented Greenberg Traurig with their

PAI Distinguished Service Award. The ACBA was thrilled to donate $19,500 to Domestic Violence agencies including Albany County Crime and Sexual Violence Center, Equinox, and the ACBA=s Pro Bono program.  This money was raised during the 2007 Law Day Run Against Domestic Violence and we are very proud to be able to give the funds to such deserving agencies.   Each attendee also bought gifts for the children at St. Catherine’s Center for Children and by the end of the evening there was a mountain of presents!!  It was certainly a stellar year for giving and we would like to thank each and every one of you for your generosity. You definitely made the children’s Holiday a little brighter.  And what would the Holiday Party be without Santa and Mrs. Claus?!?  Our sincere appreciation goes to Frank and Barbara Pell!

Saratoga Conference

On October 30, Barbara Davis and I attended a conference on AJustice Issues in Rural New York@.  This one-day seminar focused on legal services in rural areas throughout New York, concentrating on barriers to justice, the complexity of the legal system, inadequate funding and also the impact of cultural diversity. The final presentation offered that collaboration on a statewide level is the crucial next step in breaking these barriers so that all New Yorkers are afforded better access to justice.  The day was filled from beginning to end with information about legal service providers from all over New York State and was truly a learning experience.  Our own members Lillian Moy and Lisa Frisch were presenters and several other ACBA members were attendees.  It was great to see a lot of familiar faces and to meet so many new colleagues!

Our thanks to Judge Juanita Bing Newton, Barbara Mulè, John Ritchie and the rest of Judge Newton=s staff for making this happen.  I would also like to thank all the panelists and attendees for their dedication to legal services for the many New Yorkers who are, or feel, powerless in the justice system.  I look forward to future conversations like this and I am honored to have been part of this event.

Year in Review

Well it certainly has been a busy year!  In 2007, the Pro Se Divorce Program assisted close to 50 people get a free pro se divorce and coordinated over 20 pro bono cases.  The Help Desk at Albany Family Court assisted roughly 500 petitioners with their paperwork.  This number will surely increase this year with the arrival of new students and a Help Desk that is open full time!

First I would like to thank everyone who took pro bono cases during 2007: Robert Adams, paul Czech, Nancy Delain, Michael Friedman, Laura Greco, Kevin O=Brien, Demo Romanucci, Don Ross, and Doug Shartrand. 

In February, we held a Landlord/ Tenant Pro Bono CLE Training which was attended by close to 30 attorneys, several of whom took pro bono L/T cases.

In April, the ACBA was part of a APro Bono Expo@ at New York State Bar Center.  The event offered 90 attorneys the chance to learn about pro bono providers and opportunities in the area.  The Legal Aid Society, The Legal Project and the ACBA had information available for potential volunteers interested in doing pro bono.  The turnout and presentations were fantastic and a total of 20 attorneys signed up that day to take a pro bono case!  The Expo was held thanks to the inspiration of Judges Cardona and Ceresia, who spearheaded the formation of the Third Judicial District Pro Bono Discussion Group in April of 2006. This was the Discussion Group=s first major event and will not be the last.

May 1 was Law Day, a very special day for the Albany County Bar Association.  Since this year=s theme was ALiberty Under Law: Empowering Youth, Ensuring Democracy@ we did something new and asked for volunteers to speak  at local schools on various legal topics.  The response from our membership was phenomenal and the schedules were filled in just a few hours.  The feedback from the schools was outstanding and we look forward to doing similar programs in the future!

Also in celebration of Law Day, the ACBA held the 13th Annual Law Day Run Against Domestic Violence on April 27, which attracted close to 350 participants.  Thanks to them and our generous sponsors, we will once again be able to donate money to local domestic violence agencies.  This year’s AKids Run@ was a lot of fun again too!

On May 14, the ACBA participated in the ASenior Celebration and Consumer Fraud Fest@ aimed at helping senior citizens understand health care proxies and protect themselves from identity theft, predatory lending and financial exploitation.  Barbara Davis attended the event and also distributed materials and information to attendees while ACBA member Meg Reed led one of the workshops that day.  The event attracted several hundred people and we look forward to being a part of it every year.

On May 19, the ACBA Young Lawyers Committee participated in a Habitat for Humanity Build in North Albany.  But it wasn=t just for young lawyers!  Many of our other members volunteered, as did the ACBA staff.  In all close to 30 ACBA members were present and although the weather was not very cooperative, it didn=t get in the way of our support for community services like these!

After all the heavy rain and serious flooding in areas west of Albany last spring, FEMA requested our help in arranging for free consultations for people affected by the disaster.  Like the response to my recent request for help for the military, ACBA members stepped right up to the plate and offered to help in any way needed!  To the people who were injured or lost homes, cars or other possessions in the flooding, it came as a great comfort to know that they had somewhere to turn and their situations were not without hope.

Who can forget Bike Safety Day back in June?  Close to 100 members turned out to volunteer and helped fit helmets on over 200 young people!  This was a great community outreach program and we are so happy that is was such a success.  We will certainly be sponsoring this event again the near future.

In September, we held an orientation for the Albany Law School students who would be volunteering at the Albany Family Court Help Desk.  Almost 20 students were present and most of them committed to volunteering.  Now there=s a Help Desk that is fully operational and open during most business hours!

In October, the ACBA once again supported Senior Citizens= Law Day at the Albany Law School.  Barbara Davis volunteered the day of the event and gave out informational pamphlets to the 800-plus people who attended.  Another banner year for Senior Law Day indeed!

Sometimes I get overwhelmed thinking about how much more there is to do for pro bono, but when I looked back on this article I realized that we have, together, accomplished quite a lot.  I realize also that every effort makes a big difference- to our clients, to our community and to our profession.  I would like to thank each and every one of you for making this difference and I look forward to what the coming year can bring.

Help Desk Update
The Pro Bono Society and Albany Law School students have once again helped the ACBA staff the Albany Family Court Help Desk.  This semester, we have about 15 student volunteers who offer informational assistance to petitioners at Family Court.  This volunteer presence is a wonderful service to petitioners and Family Court Judges and staff and we are proud to be part of such a great program!

CLE Training on Representing the Pro Bono Debtor Under BAPCPA

Upcoming CLE Training on Representing Victims of Domestic Violence in Family Court
On December 7th, the Domestic Violence Legal Training Coalition (made up of the Legal Project, the Legal Aid Society, Albany Law School and the Empire Justice Center) is presenting a full day training session to help prepare attorneys to handle cases in Family Court.  The training will cover custody and visitation, child support, family offense basics, client interviewing and safety planning.  There will be 7.5 hours of Transitional CLE credits, inc. 1.5 of Ethics.  It will be held at the NYS Office for the Prevention of Domestic Violence at 80 Wolf Road, Albany from
8:45 a.m. – 5:00 p.m.  The training is free to attorneys who agree to accept at least one pro bono case from both the Legal Aid and the Legal Project, otherwise it’s $140 for attorneys, $70 for Law Guardians, paralegals, legal assistants or assigned counsel attorneys and $20 for domestic violence advocates.  Please contact Kristie Cinelli, 689-6322 or kcinelli@lasnny.org.

“Take Charge” Program Volunteers Wanted

The Girl Scouts of Northeastern New York will be presenting a program entitled “Take Charge! Violence Prevention, Conflict Resolution and Law”.  Co-developed by the ABA Commission on Youth and Risk, this pilot program will reach 10 US cities and teach approximately 50 local young women, ages 12 to 17, how to protect themselves from violence.  The weekend-long presentation will include discussions on teen dating violence, careers in the law, school safety, the importance of the rule of law in a democratic society, and will culminate in a Mock Trial.

The Girl Scouts are therefore seeking 8 – 10 attorney volunteers and one Judge for the Capital Region weekend program.  Many details are still being planned, but the tentative date is November 30 – December 2, 2007.  The exact location is TBD as is a specific agenda, but both will be available soon.

“Take Charge” Program Volunteers Wanted
The Girl Scouts of Northeastern New York will be presenting a program entitled “Take Charge! Violence Prevention, Conflict Resolution and Law”.  Co-developed by the ABA Commission on Youth and Risk, this pilot program will reach 10 US cities and teach approximately 50 local young women, ages 12 to 17, how to protect themselves from violence.  The weekend-long presentation will include discussions on teen dating violence, careers in the law, school safety, the importance of the rule of law in a democratic society, and will culminate in a Mock Trial.

The Girl Scouts are therefore seeking 8 – 10 attorney volunteers and 1 Judge for the Capital Region weekend program.  Many details are still being planned, but the tentative date is November 30 – December 2, 2007.  The exact location is TBD as is a specific agenda, but both will be available soon.

IOLA Update
The ACBA recently submitted the 2007 IOLA Interim Report.  I would like to take the time to remind everyone that different banks offer different interest rates on IOLA accounts. Interest rates and net yields are all posted on their website, http://iola.org/.   We encourage firms to seek out banks that offer higher interest rates on IOLA accounts, as these monies are then given back to agencies that offer free civil legal services to those in need.  Be sure to visit www.iola.org for other news about civil legal services funding as well!

 Of course, none of our programs would be possible without assistance from IOLA, Senator Neil Breslin and the Albany County Bar Foundation.  It is because of these generous gifts that we are able to provide legal services to the indigent in our community!  We are deeply appreciative of the grants we received for our Pro Bono Program and look forward to expanding our services in the future.

Legal Aid Society
The Children's Law Project (CLP) of the Legal Aid Society of Northeastern New York, Inc. provides free civil legal services to low-income children with disabilities. CLP serves Albany, Rensselaer, Schenectady, Fulton, Montgomery, Schoharie, Warren, Washington and Saratoga Counties.  We can help with a range of legal issues, including denial of benefits such as SSI or public assistance, school discipline issues, special education issues, 504 Accommodation Plans, emancipation.

The Project has open intake throughout the day, but the best times to call are 11:00-12:00, and 1:00-5:00. For more information, or to see if you or your child is eligible for services through the Children's Law Project, please contact the Albany office at (518) 462-6765 or toll-free at (800) 462-2922.

Bike Safety Day

Many thanks to all of our members who in recent weeks volunteered to offer free consultations to area flood victims.  FEMA has now set up a hotline so we will be in touch if we get requests for assistance.  If you are interested in volunteering, please let us know.

Senior Celebration
On May 14, the ACBA participated in the first annual Senior Celebration and Consumer Fraud Fest at the Albany Marriott.  The event offered senior citizens information and resources to protect themselves from predatory lending, identity theft and scam artists.  Special thanks to Meg Reed for speaking at one of the workshops offered that day.                                

Law Day
Our Annual Law Day programs this year encompassed the entire week of May 1st.  A number of attorneys spoke to area high school students in honor of this year’s topic “Liberty Under Law:  Empowering Youth, Assuring Democracy.”  The program was a great success and the students found the programs informative as well as entertaining.

On May 1, Hon. Peter G. Crummey, Colonie Town Justice, participated in Shaker Junior High School’s Law Day Program including panel discussions with students and other elected officials.

On May 2, Gerald J. Jennings spoke to four classes at Albany High School about the Death Penalty, his experience with those cases and their feeling about it.

On May 2nd, Jennifer Purcell spoke at Albany High School on the topic of “Law and Medicine.”

On May 2nd, Bruce Wagner spoke at Albany High School on the topic of “Legalities Associated with Teen Years, Rights & Responsibilities.”

On May 2nd, Maxine Barasch spoke at Albany High School on the topic of “How to Become a Lawyer” and the history of law.

On May 3rd, Hon. Ryan Donovan spoke at Albany High School on the topic of “How to Become a Lawyer.”

On May 3rd, David Finkelstein spoke at Albany High School on the topic of “How to Become a Lawyer.”

On May 9th, Richard Rivera spoke at Albany High School on the topic of “Criminal Law.”

NYSBA Award Ceremony
On April 30 the NYSBA held its Annual President’s Pro Bono Service Awards Luncheon.  Hon. Victoria Graffeo graciously welcomed and congratulated the recipients of this year’s awards. Mark Alcott and Jim Kelly then presented the awards to each recipient.  Congratulations to Michael O’Connor, Willow Baer and Olivia Nix on their awards for outstanding pro bono service!!   Ceremonies like this are a wonderful way to recognize what attorneys and other legal professionals are doing throughout the great State of New York.

Law Day Reception
The Legal Aid Society’s 6th Annual Law Day Reception on May 1st was fun and elegant, as always.  ACBA members Joanmarie Dowling and Peter Coffey won awards for their outstanding pro bono service.  Congratulations and thank you!

13th Annual Law Day Run
On Friday, April 27, 2007 the Albany County Bar Association had its 13th Annual Law Day Run Against Domestic Violence.  It was an incredibly successful day and over $15,000 was raised to fight domestic violence in the Capital District.

On this beautiful spring evening, we had over 350 participants!  Thank you to our Law Day Run Committee: Douglas Kemp and Elizabeth J. Grogan, Co- Chairs, Daniel W. Coffey, Carolyn D’Agostino, Tricia George, Diane Metz, Amanda Petrie and Robert Rausch.  Their efforts cannot go unnoticed and the event would not have been such a great success without their assistance.

Finally, thank you to each and every volunteer, including Diane Metz, who once again assisted us in organizing all of the volunteers.  This race would not have been possible without their efforts.

At a time in which lawyers are deemed not to provide any type of assistance in the community, I am particularly proud that the Albany County Bar Association has worked so hard to raise this money which will be used to fight domestic violence by providing services such as security deposits, new locks, clothing, emergency housing, moving assistance and other valuable services.  We look forward to all of you participating next year and thank you again.

Pro Bono Expo

Our first pro bono expo was held on April 18 at NYSBA.  The event offered close to 100 attorneys the chance to learn about pro bono providers and opportunities in the Capital District.  The Legal Aid Society of Northeastern New York, The Legal Project, the ACBA and the Albany Housing Coalition had information available for potential volunteers who were interested in doing pro bono. 

The turnout was very impressive and the presentation was fantastic!  We heard members of the Bench and Bar explain why everyone should and can do pro bono.  Our esteemed panelists included:  Hon Jospeh Teresi, Hon. Linda Griffin, Hon. Chris Hummel, Hon. Gary Stiglmeier, Hon. Leslie Stein, Anne Reynolds- Copps, Michael Friedman (who also served as the Moderator), Dan Hurteau, and G. Kimball Williams

Pro Bono Society

Albany Law School’s Pro Bono Society will be hosting this year’s Loan Repayment Assistance Program (LRAP) fundraiser and cocktail reception on Thursday March 22 at 7:30 pm at the Albany Law School. Items donated by local businesses and the Albany Law Community will be available in silent and live auctions, hosted by Susan Arbetter of WAMC radio.  Donations range from gift certificates to local restaurants to private wine tasting to sushi-making lessons--so there is something for everyone!  All money raised will be used for scholarships, given to graduating students who take low-salary public interest law jobs.   For more information, or to make a donation, please contact Willow Baer at wbaer@albanylaw.edu.  Wine and hors d'oeuvres are complimentary and, of course, everyone is invited to come and spend some money!

The Albany Family Court help desk continues to succeed thanks to the efforts of ALS student volunteers, the Family Court Judges and staff, and of course Willow Baer and Olivia Nix of the Pro Bono Society.  We applaud your dedication to helping the self-represented!

Once again, the IOLA Fund for the State of New York has made it possible for the ACBA to continue to provide free civil legal services to the indigent and working poor in our community.  We are deeply appreciative of the grant we received for our Pro Bono Program and look forward to expanding our services in 2007.  None of our programs would be possible without assistance from IOLA, Senator Neil Breslin and the Albany County Bar Foundation.  It is thanks to these agencies that we are able to provide the services we can!

In an effort to accomplish our goals, we hope to be able to offer more training for attorneys who are willing to provide pro bono legal services.  We held a landlord/ tenant training on February 1 and hope to offer more later on in the year.  If there is a particular area of law in which you think training would be beneficial, please email me at sblank@albanycountybar.com.  I look forward to hearing your suggestions and also to another banner year for pro bono services!

Holiday Party

>TIS THE SEASON!!! And our 12th annual Holiday Party definitely confirmed that!  The Legal Aid Society, co-sponsor of the event, presented Ira Mendleson with their PAI Distinguished Service Award.   The ACBA was thrilled to donate $15,000 to Domestic Violence agencies including Albany County Crime Victim and Sexual Violence Center, The Legal Project and the ACBA=s Pro Bono program.  This money was raised during the 2006 Law Day Run and we are very proud to be able to give to such worthy causes.  It was definitely a stellar year for giving and we would like to thank you all for your generosity! Also, we would like to thank everyone who donated to the children of Parsons and made their Christmas a little brighter.  And what would the holiday party be without Santa ?!  Our sincere appreciation goes to Michael Rhodes-Devey!

On October 4, the Pro Bono Coordinators Network gathered in Albany for its quarterly meeting. We discussed the many new initiatives designed throughout New York to facilitate access to justice.   As always, the meeting was very informative and Barbara and I got some great ideas for pro bono opportunities in Albany!

Save the Date- the ACBA and Legal Aid Society are planning a Landlord/ Tenant training for February 1, 2007.  Keep an eye out for details in upcoming newsletters. 

The Family Court Help Desk has extended hours and services!  Volunteers will now be available on a more frequent basis during the week.   Petitioners will now have more opportunities to get the information and guidance they require.  We are thrilled to be part of this project and would once again like to thank the family court judges as well as David Cardona, Willow Bear and Olivia Nix for their initiative in this project!

Family Court Help Desk
As you may know, the ACBA has been working with Albany Family Court to staff the Help Desk there.  Currently I, the Pro Bono Coordinator, spend one day a week offering procedural assistance and information to petitioners.  In an effort to increase help desk hours and staff, the ACBA has been actively trying to recruit law students.  On September 21st David Cardona, Regina Treffiletti, Meghan Cardona and I spoke to about 35 students who were interested in volunteering.   Thanks to our collaborative efforts we are anticipating good results in achieving access to justice.  We would like to thank Law Students, Olivia Nix and Willow Baer  for their initiative on this project!

Once again, the Legal Services Partnership Conference was enlightening, informative and fun!  While Barbara Davis and I attended workshops devoted to pro bono legal services, many sessions were offered during this 3 day conference, including sections on Diversity, Family Law, Criminal Law and Housing laws.  A lively discussion on pro bono initiatives in NY highlighted local pro bono action committees in the 5th, 8th and 9th judicial districts.  We also attended a session on utilizing law school students to provide expanded pro bono legal assistance.  Since ALS students Olivia Nix and Willow Baer will be helping with the Albany County Family Court Help Desk this was the perfect session for Barbara and me!  Barbara attended a session on using technology to deliver legal services.  Probono.net and LawHelp/NY have been invaluable to people looking for legal assistance in New York

IOLA Annual Report
Last month Barbara Davis and I completed the IOLA Grantee Annual Report.   We were very proud of our achievements in coordinating pro bono assistance for 55 clients.  This, of course, is in addition to the 100 clients who benefited from our pro se divorce program.  Not only could we boast about the success of these programs, we were also very proud to have started the Help Desk at Albany Family Court.  As you can imagine, there are many petitioners who seek information when filling out family court papers.  At the moment we are trying to expand the Help Desk by recruiting volunteers and have been working closely with ALS students to make that happen.  We thank all the attorneys who took pro bono cases for us; Michael Friedman for supervising the divorce program; the Judges and staff at the Supreme and Albany Family Courts for being so receptive about our programs; the Help Desk and the ALS students who are so eager to help us expand our services in Family Court.  We really would not be able to do this with out your help and support!

Law Day 2006
Liberty Under Law: Separate Branches, Balanced Powers

Law Day is always very meaningful and informative and this year’s celebration was no exception! In addition our Law Day consultations, Barbara and I attended the President’s Pro Bono Service Awards luncheon at the NYSBA Center. Chief Judge Judith Kaye gracefully gave opening remarks despite her busy Law Day schedule. Awards were presented by NYSBA President A. Vincent Buzard and by our very own Jim Kelly, Co-chair of the President’s Committee on Access to Justice. Attorneys from each judicial district were awarded for outstanding pro bono service; Third District winners were Richard Croak and Scott Fein!

Later that day it was off to the Fifth Annual Law Day Reception at the Albany Law School. Co-sponsored by the ACBA, Albany Law School and the Legal Aid Society of NENY, this event honors those who provide exceptional pro bono service in our community. Our esteemed President James T. Potter presented Michael Whiteman (Whiteman, Osterman & Hanna) with an award for his pro bono efforts; other honorees included ALS student Benjamin D. Gold and also the Times Union Editorial Board. It was a lovely evening and the ACBA is proud to be part of the event.

Our Law Day Run just keeps getting better and better! This year’s 12th Annual Law Day Run Against Domestic Violence was our most successful Run to date! The weather was beautiful, the energy level was high, and the volunteers and staff worked harder than ever! There were 315 runners, of whom almost 100 registered on the day of the race. We also had about Overall winners this year were Meghan Davey and Chuck Terry. We thank our members and donors, without whose support and generosity the Run would not be possible. We thank our volunteers whose hard work and dedication make this our best fundraiser. And we thank all the runners, who take a stand against domestic violence by participating in this very special event.

Access to Justice
On May 11th and 12th I attended the "Access to Justice for the Self-Represented" conference in White Plains. This fascinating meeting provided an in-depth look at programs offered around the country that support self-represented litigants’ access to justice. Speakers and panelists shared their insights and expertise on topics such as: the difference between legal information and legal advice; recruitment, training and supervision of volunteers; and enhancing legal services through technology. It’s always so great to see what other agencies and Bar Associations are doing; and I was really glad that we offer our pro se divorce program and have the Help Desk in place at Albany Family Court.

Law Day USA
On May 1, 2006, the ACBA sponsored the Annual Law Day USA. That day, several attorneys volunteered their time to offer free legal consultations to residents of the Capital Region. The 12th ANNUAL LAW DAY RUN AGAINST DOMESTIC VIOLENCE
On Friday, April 28, 2006 the Albany County Bar Association had its 12th Annual Law Day Run Against Domestic Violence. It was an incredibly successful day and over $15,000 was raised to fight domestic violence in the Capital District.

On this beautiful spring evening, we had over 350 participants! Thank you to our Law Day Run Committee: Douglas Kemp and Amy Quandt, Co- Chairs, Diana Bangert-Drowns, Ruth Brennan, Daniel W. Coffey, Elena M. R. DeFio, Tricia George, Gayle Hartz, Stephen Levy, Diane Metz, Amanda Petrie, Robert Rausch and Ann Sharpe. Their efforts cannot go unnoticed and the event would not have been such a great success without their assistance.

Finally, thank you to each and every volunteer, including Diane Metz, who once again assisted us in organizing all of the volunteers. This race would not have been possible without their efforts.

At a time in which lawyers are deemed not to provide any type of assistance in the community, I am particularly proud that the Albany County Bar Association has worked so hard to raise this money which will be used to fight domestic violence by providing services such as security deposits, new locks, clothing, emergency housing, moving assistance and other valuable services. ALS Forms Pro Bono Society
In December, Albany Law School students Olivia Nix and Willow Baer created the student- based Pro Bono Society which aims to instill the importance of public service in all graduates of Albany Law School. By encouraging students to get involved in pro bono projects with legal services organizations in our community, the Pro Bono Society helps students take on their professional responsibility of insuring equal access to justice. Students will be matched with local organizations and projects to donate their time and skills where they are needed.

The Society held its first meeting on January 31 at the ALS to acquaint students with representatives of various organizations that provide free or low cost civil legal services in the Capital District. Distinguished panelists included: Lillian Moy of the Legal Aid Society of Northeastern New York; Anne Erickson of the Empire Justice Center (formerly GULP); Michael Friedman of Friedman & Molinsek, on behalf of the ACBA; Ellen Schell of the CDWBA’s Legal Project; and Matthew Traux, 3L at Albany Law School. In addition, Jim Potter, Barbara Davis, myself and about 35 students filled the Rochester Moot Courtroom.

Each speaker described what their respective agencies "do" and suggested areas in which the Society could help. Of course, a number of opportunities were presented including: the Legal Project’s Affordable Housing program, the ACBA’s new Family Court program; LAS’ bankruptcy, health care proxy, living will clinics; the EJC’s Immigration and Domestic Violence program and the class action law suit against the City of New Orleans in which several ALS students are helping. This discussion spurred more conversation on the many opportunities available in a host of different venues.

Kudos to Olivia and Willow for creating the Pro Bono Society and to Professor Bridgit Burke for encouraging Ms. Nix to start the group. The Society is an excellent way for non-profits to expand legal services and a perfect opportunity to law students to gain exposure and hands-on experience in the legal profession. We at the ACBA are truly looking forward to a close working relationship with the Society!

This year is off to a great start; Jim Green and Brian Lyda have already taken pro bono cases for us!

Many, many thanks to those attorneys who took pro bono cases in 2005. Lawrence Becker, Gayle Hartz, Carolyn Snyder Lemmon, Tamara Mustain, Kevin O’Brien, Don Ross, JoAnn Shartrand, Kimberly Verner, and Fred Wander all volunteered to help and made a world of difference in the process!

We also thank Michael Friedman for taking 4 contested divorce actions that originated in our pro se program. In all, Michael supervised divorces for close to 100 clients in 2005. Our sincere appreciation also extends to the Judges and Clerks who helped facilitate the divorce process for our pro se clients. We’ve gotten several thank you notes expressing their heartfelt gratitude for our time and assistance.

Many thanks to David Cardona for making possible our new program to assist pro se litigants fill out petitions in Family Court. I spend every Wednesday there and I think it’s been a big help so far. The petitioners have come to feel more confident about their paperwork and appreciate someone taking the time to help them individually. Each Wednesday has gotten progressively busier for me and a few people have actually called ahead to see if I was there to help. We’re looking forward to this program becoming a huge success!

Of course, all of these programs and activities would not have been possible without generous grants from IOLA, Senator Neil Breslin and the Albany County Bar Association. We thank them all for their generous support.

Holiday Party

‘TIS THE SEASON!!! And our 11th annual Holiday Party definitely confirmed that! The Legal Aid Society, co-sponsors of the event, presented Richard Croak with their

PAI Distinguished Service Award. The ACBA was thrilled to donate $22,000 to Domestic Violence agencies including Comprehensive Crime Victims Assistance Program, Equinox, The Legal Project and the ACBA’s Pro Bono program. This money was raised during the 2005 Law Day Run and we are very proud to be able to give to such a worthy cause. Also, the Albany County Bar Foundation made a generous contribution to the NYSB Foundation’s Katrina Relief Fund. It was definitely a stellar year for giving and we would like to thank you all for your generosity! Also, we would like to thank everyone who donated to the children of Parsons and made their Christmas a little brighter. And what would the holiday party be without Santa and his elf! Our sincere appreciation goes to Frank Pell and his elf Alexxa Lewis.

Time of Giving
The holiday spirit is certainly among us here at the ABCA! This year’s Holiday Party will be held on December 15, 2005 at the brand new Hampton Inn, Downtown Albany and will be catered by Yono himself!! As in the past, we have already begun collecting "presents" for the children at Parson’s. This is always a fulfilling event, since we really get to help those who need it most and feel good that we are in position to do so.

To make the Holiday party even more exciting, we’ll be distributing funds from the 2005 Law Day Run to various agencies in the Capital District that do good work for Domestic Violence Victims.

Also, our Foundation has donated $5,000.00 to the Katrina relief fund (P.S. It is not too late to donate). It too will be presented to the NYSB Foundation at the Holiday Party.

So please be sure to attend this year’s event! It surely is one you should not miss! A flyer is enclosed with this newsletter for you convenience.

Domestic Violence Court
On October 26, 2005 a special ceremony was held for the opening of the Albany City Domestic Violence Court. City Court Judge William A. Carter will preside over the Court, which was made possible by hard work, support and dedication by numerous individuals and agencies in Albany County. In September, Barbara Davis and I attended the Pro Bono Coordinator’s Network meeting in New York City. We always find the Network meetings to be insightful, educational and lively and this was no exception. This meeting focused on how to increase pro bono in law firms and how to work with the media in promoting what firms and attorneys are doing. Panelists included downstate advertising guru Steven Alschuler, Steven Horowitz of (our gracious hosts) Cleary Gottlieb, and our very own Michelle Wildgrube. Suggestions were also made on how to expand pro bono in Family Law, Health Care Law and Business Law sections. An eye-opening report was given on Guantanamo Bay detainees and the pro bono opportunities available for attorneys who would like to help them.

In October, Barbara and I met with David Cardona of Albany County Family Court to begin plans for assisting pro se Family Court litigants fill out the requisite paper work. This will not only help the pro se litigants but will hopefully take some of the burden off of the attorneys and staff members who do so much work there. Starting next week, I will be at Family Court one day a week to help out. As time goes on we hope to increase our presence and expand our role. We’re really looking forward to making this program a great success!

After our September Board meeting, ACBA Treasurer Pat Higgins has agreed to serve as a liaison between our Board of Directors and our Pro Bono programs. In his role he will be working closely with the pro bono panel, Pro Bono Chair Jim Kelly, and with the other Board members in an effort to increase pro bono activities and awareness in the Bar Association. Thank you Pat!

Barbara Davis and I will soon be attending the quarterly Pro Bono Coordinators Network meeting in New York City. The conference will focus on various pro bono efforts and opportunities throughout the state. For example, a panel discussion will concentrate on how firms and agencies can increase pro bono participation, raise awareness of pro bono and receive positive press. In addition, an update on pro bono for Guantanamo Bay detainees will be presented by representatives from the Center for Constitutional Rights. The agenda has recently been revised to also include a discussion on Katrina relief efforts throughout New York. As always, it’s sure to be a very insightful meeting. Keep an eye out for a full report in November’s newsletter!

Annual Report
This month Barbara Davis and I had the arduous task of completing our annual IOLA report. Looking at our achievements in the last year and comparing them to the goals we had set for the Pro Bono Program, we were both truly proud of our pro bono accomplishments. Thanks to our member attorneys who took so many pro bono cases, we were able to assist more than 50 people get the kind of representation that they needed and deserved! I can’t tell you how much your help means to us and to your clients!

Law Day Reception

It was well attended and this year's event was highlighted by the presentations of the Servant of Justice Award to The Honorable Eliot Spitzer, Attorney General of the State of New York, and the Community Advocate Award to Mr. Edward Swyer of the Swyer Companies. We also honored E. Stewart Jones, Jr., and the law firm of McNamee Lochner Titus & Williams, PC and an Albany Law School third year clinical student, Amy Karr-Cook, class of 2005. It was a great success and we thank all the honorees!

Pro Bono Training
On Wednesday, May 4 the Albany County Bar Association and Legal Aid Society of Northeastern New York will host a training on Unemployment Insurance. This Seminar will offer 3 CLE credit hours and is free if you’re able and willing to take 2 Unemployment cases from either ACBA or LASNNY. Everyday our office is flooded with calls from people looking for Unemployment Law attorneys. Unfortunately we don’t have any on our Referral Service or on our Pro Bono Panel! If you haven’t done so already, please sign up for the training today and do the public good.

Taking pro bono cases just got a little easier!! The Capital District Paralegal Association has graciously offered their assistance in helping our members with tasks such as research, drafting and preparing documents. Please contact the ACBA at 445-7691 and we’ll make the arrangements!
